Welcome to LandWatch.com's User Agreement. This Agreement describes the terms and conditions applicable to your use of our services at LandWatch.com and its auction services. If you have any questions that are not answered here, please contact the Webmaster.
This Agreement is effective immediately. We may amend this Agreement at any time by posting the amended terms on our site. This Agreement may not be otherwise amended except in a writing signed by you and LandWatch.com. This Agreement was last amended on September 26, 2006.

Notices
Except as explicitly stated otherwise, any notices shall be given by postal mail to LandWatch.com, 4957 Lakemont Blvd SE C-4, PMB 352, Bellevue, WA 98006. Notice shall be deemed given 24 hours after email is sent to you at the email address you provided, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to LandWatch.com during the registration process. In such case, notice shall be deemed given 3 days after the date of mailing.
Arbitration
Any controversy or claim arising out of or relating to this Agreement or our services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Seattle, Washington, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or LandWatch.com may seek any interim or preliminary relief from a court of competent jurisdiction in Seattle, Washington necessary to protect the rights or property of you or LandWatch.com pending the completion of arbitration.
Release, Waiver and Covenant Not to Sue
To the fullest extent allowed by law, User hereby releases and discharges LandWatch.com and each of its officers, directors, employees, shareholders, affiliates, business partners, customers and any other authorized agent or representative of LandWatch.com from any and all liability associated with User's use of the LandWatch.com web site. This release shall apply to any and all claims, known or unknown, held by User. User hereby also agrees and convenants not to sue, and expressly waives any and all claims against, LandWatch.com for any claim that is released hereunder or for any amount in excess of the limitation of liability provided in this Agreement.

This is the entire agreement between the parties relating to the subject matter hereof and no waiver or modification of these Terms and Conditions shall be valid unless in writing and accepted by each party. The waiver of a breach of any term hereof shall in no way be construed as a waiver of any other term or breach hereof. If any provision of this Agreement shall be held by a court of competent jurisdiction to be contrary to law, the remaining provisions of this Agreement shall remain in full force and effect.
